you saying BRP  is sort of ID card like residence permit ! what happen to ILR stamp on passport? did they stop issuing it? how long is the BRP valid for and when are you gonna apply for the British Citizen passport?

aorry to interupt but i have a simular problem

i am a british born wife and married my husbnd who came on a student visa 3 years ago we only got married in novermber 2011 and thrn i fell pregnant between that time anayway in april we applied for his visa and waited roughly 7 months for a reply which was my husband got shis visa which on his biometric card it says leave to remain and no public funding but hes is allowed to work.. buy the queestion is what about me. i stopped working after he got his visa and now im siyting T home i recive child benifit but am o entitled. to any tother benifits? we also at the time we got marries till now are living with my brother in law and now we have our visa and baby allhumdullilah who is now 4 months they have told us to leave the house and want us out by the end of this month which is march the 30th.. we have no where to go and also after the 30th march we will be homeless.. my husband works 16 hours a week and does occasinally cash in hand jobs but gets roughly 200 a week.. be ause we have no where to go we have applied for a council home to rent.. and i have applied and rher asking for my husbands details and will they reject my application or will this effect his visa for settlement whch he will apply for in two years tome?

will they look at my husbands earnings and think we wont be able to pay rent as he dont get much?

if we apply for housing benifit will i affect him?

am i entitled to anything?

i stopped working due to having my baby

what can i get apart from child benifit bearing in ind husband works only 16 hours so he dont pay tax?? please reply asap

Dear Sister
Salam. Your husband is on spouse visa. If he could work 30 hours or more, he could claim Working tax credit and you could claim Child tax credit together with Child benefit. You could also claim housing benefit and council tax benefit. In this case, your husband will not be said to claim Tax credits as he is a spouse of a British Citizen and it will not be illegal. 
What you need to do..

1) Go to Job Centre Plus and make an appointment. Ask them for possible benefits available for you and your husband. They will give you some phone numbers to contact. Contact them and they will tell you what to do.

2) Go to your city council and fill out Housing Benefit form and submit. If they say that you are not eligible as your husband is not supposed to get public fund, show them the Public Fund brochure which says that a British partner can include his/her partner while claiming for Housing and Council Tax benefits. Click of the link below and read carefully. Print it out and take to city council.

May Allah reward you for your comprehensive and sincere advice on the forum. Can you please look at my comments in red and see if you can help me. 
1) Passport size photos, yours- 1 and partner's- 2.
2) Passports of your partner and your. Do 
3) Biometric residence permit- Your partner's - Section 6 of the form states that " please note for the application to be valid and complete your current Biometric Residence Permit must be provided" if it is not available the form demands explination i.e. lost, stolen, other and return to UK bprder Agency. This very, very confusing we are not sure whether we need to fill in this section. My wife done a figure print and picture In FedEx, as part of her spouse visa application in Islamabad in 2010 - she submitted the same with her spouse application and she has no record of it, it was not returned to her either -? if so shall I say YES to the question in the form? or do one in the post office?

IF YOUR WIFE DO NOT HAVE A BRP, YOU DON'T NEED TO SUBMIT IT. IT IS ONLY ISSUED FROM UK. I APPLIED FOR SPOUSE VISA WITHIN UK, SO THEY GAVE ME BRP. IN YOUR WIFE'S CASE, THE VISA STAMP ON PASSPORT WILL SUFFICE I THINK.

4) Marriage certificate - Marriage cert is from back home which they used as evidence to issue my wife a spouse visa - i wonder why it is needed for ILR 

THE MARRIAGE CERTIFICATE IS THE PROOF OF YOUR MARRIAGE. IT IS ESSENTIAL TO INCLUDE. YOU SHOULD INCLUDE AS MANY DOCUMENTS AS POSSIBLE TO AVOID ANY DELAYS. THEY MIGHT ASK FOR IT IF YOU DON'T INCLUDE AND IT WILL DELAY THE VISA DECISION.

5) Bank statements (preferably jointly)
6) Pay slips (yours and partner's if she is working)
7) Life in the UK test letter (your partner's)
8) 6 letters to you and your partner from 3 or more different sources in last 2 years.. I I thought we need 6 pieces of evidence to proof we are living in the same address - but from you list it seems like the 6 letters has to be in addition to the Bank statements, Life in the UK test, and tenancy agreement - correct? If so, is it 6 x letter for me and 6 x letters for my wife?
I also noticed from you reply to brother Khalid that it has to be from 3 different sources. over the 2 years period If my wife receives 3 letter (1x from GP, 1 x from hospital , 1 x from specialist) but all letters are headed NHS letters are they considered as 3 sources or one source?

IF YOU DON'T HAVE LETTERS OF JOINT NAME, NO WORRIES. JUST INCLUDE LETTERS SENT TO YOU AND YOUR WIFE SEPARATELY BUT TO THE SAME ADDRESS. FOLLOW THE CHECK LIST CAREFULLY AND DO NOT MISS ANYTHING YOU CAN PROVIDE. KEEPING THIS ISSUE IN MIND I ALWAYS INCLUDE MY WIFE'S NAME IN REGISTRATIONS, LIKE BANK ACCOUNT, TENANCY AGREEMENTS ETC.

9) Tenancy agreement ( preferable in joint name) - we live in a 2 bedroom flat with my brother, so there are 5 people living in a 2 bedroom flat (2 x children and 3 adults) - I am worried if I provide the tenancy agreement they might say the flat is overcrowded - shall include the tenancy agreement?

TENANCY AGREEMENT SHOWS HOW YOU LIVE AND IF YOU HAVE PROPER ACCOMMODATION FOR YOU AND YOUR WIFE AND CHILDREN IF ANY. SO IT IS A MUST TO INCLUDE. IS IT IN YOUR BROTHER'S NAME? IF SO, YOUR BROTHER SHOULD GIVE YOU A LETTER STATING THAT YOU AND YOUR WIFE RESIDE WITH HIS FAMILY.

10)  Bank savings statement (preferably in joint names) 
11) Tax credit letters (if any)
12) Work contract letters (your and your partners)

ILR stamp on passport is no more given. It has been replaced by BRP. The BRP shows that my ILR is valid till 2022. But I will apply for Naturalization in a year and then apply for a British Passport insha-Allah.

ive only just realised my husband does work 30 hours also does this mean i can claim child tax credit amd working tax credit? doesent that come under public fundings also
if inapply for housing benifits wont it effect his application for a stay in the uk?


i have applied for housing and they are looking at my appplication as a restricted application due to my husband not having a stay in the uk..

i am the one whos made the claim amd have my husband on the application...

can i apply for housi benifit?

if so that would be an advantage..

also i cantclaim jsa...

we are legally married in the uk and islamicly...

Please check the link I posted earlier regarding the public fund. You and your husband can claim Tax credits as I did with my British Citizen wife. And it did not have any adverse effect on my ILR application.
Regarding housing benefit, both of you can claim legally, but council staffs might say that it will affect your husband's future visa application. If they say that, then leave it.

·        2.16 on page 8 asks:  what type if ceremony was your wedding? We have celebrated our wedding in a wedding hall and we obtained an official marriage certificate which we used for my wife’s spouse visa application and successfully obtained her visa. I am not sure what type of ceremony to state – any idea?


I GAVE 'MUSLIM WEDDING CEREMONY'.


·        2.26 on page 10 states: do you or your partner have any shared financial responsibility. My wife does not work and does not receive any benefit. I work full time and pay for all of our expenses. Do you know what this shared responsibility means – is it to do with payment to someone else etc?


FINANCIAL RESPONSIBILITY MEANS THAT YOU OR YOUR WIFE HAS ANYBODY TO SUPPORT FINANCIALLY. IF YOU HAVE, INCLUDE IT.


·        Section 3 on page 10 asks for details of children under 18 living with you in uk and are applying for ILR as your dependent. Do I provide these details and list them in 3.6 page 11. The reason I am confused by this question is that because we have 2 children and they are both British, and none are applying for ILR – the question seems to ask for children which fills both conditions (living in the UK and applying for ILR) – can you please give me some advice on this.


I GAVE MY CHILDREN'S DETAILS THOUGH THEY WERE NOT APPLYING FOR ILR AND THEY WERE ALL BRITISH CITIZENS. I HAD TO COPY THE PAGE FOR MY THIRD CHILD TO INCLUDE.


·        9.12 on page 23 states: what ties with your country – can you please advice what should I write.

PLEASE INCLUDE YOUR FAMILY MEMBERS LIKE MOTHER, FATHER, BROTHERS AND SISTERS HERE WITH THE COUNTRY NAMES.

i got 27 month spouse visa
can i apply for I L R  in july 2013 after 5th of july 2013
cuz my 2years will complete on 3/8/2013 But i went to home country for a month so techinaclly i was out of uk for a month.
WHAT IS THE BEST WAY TO MAKE MY CASE REALLY REALLY STRAIGHT FORWARD WITHOUT ANY TINY DOUBT 

i am working full time my wife doesnt work but we are not claming any thing
i am just wondering is my case is straight forward for I L R
cuz i am sort of scared from H O i had really really bad previous experience from them and especially H O call centre they really really dont know wot they are doing different ans from different pplz but same question .
And every one know about home office they dont botherd about rules and laws 
e.g if requirement is you have to move from one room to another and then apply (this is  law for applying )
But H O u have to go from one room to another with out clothes ON but law requirements is just and just go to different room 
BUT H O made thier own rule with out knowing any one they just playing around for nofin
Any way i will really great full if u plz kindly help

Who says home office does not bother with rules and laws? If what you say is true, then how come you got the visa in first place and came to this country to live. If you have such disgust about the government of this country, then why are you here? Why do you want to apply for ILR? Why not pack your bags and live in a country that is fair and plays by the rules?

I do not own this country, and neither do you.
But I do not have the disgust for this country.
On one side you have only bad things to say about this country, and on the other side you are looking around for information to get ILR.
So, if you think there is no rule of law in this country, then I would say again, why not find a country that has rule of law, and live there?

I need some help the ansers above are very clear but I need to know some things:

1) My wife's Spouse Visa was granted on April 2012 how does she go about getting ILR?
2) To sit the Life in the UK does she need to do ESOL first? To level B1?
3) Does she need to work and if so how many hours?
4) Is there anything that I can do to speed up process her Visa finishes next year July 2014 and she is currently pregnent?
5) Can the Spouse Visa be extended and if so how much will it cost?

Also please mention your spouse's previous immigration status in UK, if any.
Or did she get spouse visa from outside UK? When does the visa expire? When did she arrive in UK?
Give full details please.

i think she will get ilr after 5 years because my cousion has da same case and they will give her 2.5 years visa.
she dont need to work to get ilr if you are working.
she dont need esol life in uk test is enough for ilr.
there is nothing to speed up process just wait and apply before 28 days visa finishes.
spouse visa extended to ilr after 5years .

@ ali akber, please do not sound like an expert when you are not. Stop giving cowboy advice. Every case is different. I have asked the relevant questions to establish under what category OP's wife fall into.
