I'm not an expert on this however bursary is not a public fund so there is no reason it should affect your ILR application. Also, when you apply for public funds they should ask for your passport to see whether you are eligible or not.

i have sort of same prblem about public funds, i didnt have any clue regarding this public funds, so when I had my son Ived applied or filled up a form given to me by the hospital included to my maternity pack and one of this is the child benefit forms, I have no recourse to public funds in my passport but as I didnt have any idea about this, i have submitted the forms and they have granted me the child benefits. I have learned that this will affect my application of the ILR so phoned them up to stop paying with the benefit. DO i have to start paying them back? thinking that its not my fault that they have granted me this? any advice? thanks

I always thought that child benefit is the rights for the child and it is not for the parents but off course parents sign for them.  So if you are legally settled here, your child will get the benefits but again this is not for you.

You should be OK as long as you don't get benefits for yourself. Home Office considers Tax credit as a public fund but I do dispute their definition of it because you only are paying less tax and you won't get any tax credit if you are not working.  I am not a solicitor so I can't fight them.

Any way this is my own opinion. I still think in your case child benefit goes to your child and you shouldn't have to pay it back unless your child is not legally settled here.

To Adela regarding child benefit

As you have no recourse in your visa you cannot claim child benefit but if you have a spouse who is a british citizen then a claim can be made.

Regarding repayments... I am not sure, I think every case is decided on its merit, see this link for more information   http://www.hmrc.gov.uk/manuals/dmbmanual/DMBM695030.htm

Honesty is always the best policy and if these overpayments show up during your ILR application it may (or may not) have an adverse affect.

As you have already contacted the tax people and made them aware of the payments you weren't entitled to, I think you may hear back from them in due course

can any one advise if i am entitled to recieve bursary
concerning my education as , i came in as a student and now i have been granted limited leave to remain on the basis of my relationship

i intend studying nursing at the university , am i entitled to the bursary, as on the visa stamp- there is a note that reads NO RECOURSE TO PUBLIC FUNDS-
as i dont want to jeapodise my chance of indefinite leave to remain.
