I am sure you have a solicitor. Best to ask him all these questions. Defendant does not need to reply. If they want to miss the deadline, then what's it to you?
If they miss the deadline or they don't miss the deadline, you carry on with your action.

hello, yes my flrm was refused twice. first time i was under 21 years old at that time, now changed, i ask for reconsideration, they replied " we are going to reconsider your case outside immigration rules, please do not write to us unless its an emergency" and i was waiting nearly one year and they never sent anything despite writing to them. so I thought if I made a fresh application they will open my case, here comes the refusal. My visa had expired and too late with new rules i had 21 day to leave the country. As you can see they never open whole my file, cos some of my original doc, bank statements, payslips etc. never came back. i sent pre-action protocol, no answer from UKBA. now i'm waiting from the TSols after i lodged my JR application, hopefully with a positive answer, but to be honest you never know what u expect from them.

Well, the biggest error you made was to make another flrm application. This second application was bound to be refused as it was out of time. When they said they will re-consider your first application outside the rules, then you should have chased that up.If you chased it up properly, you would have surely got Discretionary Leave.

When you made another flrm application, that meant they could not re-consider your first application, as you had made another application. But then this second application was to fail 100 percent because it was an out of time application.

So basically you spoiled all your chances yourselves by taking the whole thing up as a DIY project.

Now, your best bet it to take advice of a good immigration solicitor and show him all your case history.

Hello, 

Please if someone have experienced or now anything about Defendant’s Acknowledgement of Service. My FLR (M) was refused 2 times by UKBA for some reasons. The only way left to challenge their decision was JR. I have applied for Pre action protocol and than Judicial Review. The date when I lodged my application within High Court, Treasury Solicitors and UKBA was 3th of May 2013. I received Acknowledgement Letter from TSol and Administrative Court but not jet from Diffident ( UKBA). Is there any chance from them not to reply or miss JR deadline (24/05/2013)? IF so who takes the decision for my case? I really appreciate if anyone can help. Thank You
