you should not panic, since you are entitled to benefits as an ILR.When feeling form make sure you do not tick for your partner, when they ask whether he is on benefit, because he is not, except yours. Good luck with it.

But Nasera is not "an ILR" as you put it...

I don't pretend any great expertise in this area, but my understanding is that, for Child Benefit, there is no problem so long as the claimant is the  British citizen half of the couple.

And for tax credits, there is provision in the legislation whereby the "subject to control" partner is treated for this purpose only as being NOT subject to control provided the tax credit claim is made in joint names.

Can anyone help me for the followings:-

I am British Citizen and my family are indian citizens came in to uk with 2 years visa expiring on 20/01/2007, I need to apply for ILR for my family but I am receiving the following benefits, did this make any problem applying to get ILR for my family ?

1. I am receiving Child Benefit

2. I am receiving Child Tax Credits

3. I am receiving Working Tax Credits

I am receiving the above benefits for last one year, when I applied for FLR for the short period of one month from 2 years completion I have received a letter from home office saying that my wife or in addition (me) your sponsor is not entitled to claim or receive any public fund on behalf of my wife.

Than I have tried to stop tax credits but unfortunateley they were not stopped and received letter from Tax office saying I am eligible for receiving the above.

Can you please help me how to overcome with this problem to apply and get ILR for my family.
