If your husband was born in UK before 1983 (and his father wasn't a  foreign diplomat) he is a British citizen otherwise than by descent. Provided that your were married when your daughter was born outside the UK, she is a British citizen by descent from him - under section 2(1)(a) of the British Nationality Act 1981.

No need to include her her in your naturalisation application; she is not capable of being registered as a British citizen, because she already is one.

Yeah, my husband was born in UK before 1983 and his father wasn't a foreign diplomat. We were married when my daughter was born. Thanks for your advice.

Hi everyone,

Could someone help me clear this confusion. My husband was born in britain before 1981, he travelled back to my native country with the parents then applied for british passport from there in 2002 and travelled back to britain. I was married to him in 1998 and got our daughter abroad. Does she automatically qualify to apply for british passport or should she register? both me and her got our indefinite leave to enter for settlement three years back. I want to naturalise do I register her?

Thanks,

Mary
