Unemployment shouldn't affect a naturalisation decision - the time that that makes a difference is when you're applying for ILR.

CCJs could make a difference, I think - rightly or wrongly, the Home Office could draw the conclusion that they cast a shadow on the character of the person concerned. They don't have to prove you're of "bad" character in order to refuse your application - they have to be "satisfied" that you are of good character. If they have doubts - eg unresolve CCJs, or a pending traffic offence where conviction would make a difference, then they may not be able to be satisfied. My own inclination would be to get your finances on an even footing before applying. I'm not saying you need to pay off all your debts, but you may need to show that you're making progress in doing so.

And I think your friend's case is a perfect example. A guilty verdict in his case would have made a difference to the outcome of a naturalisation application. It is true that he is innocent until proven guilty, but the fact that the case was pending meant that HO couldn't be satisfied that he was of good character until the case was concluded, with either a guilty or not gulty verdict. And the fact that he attempted to conceal it made it worse.

Thanks for your reply,but i find it quite hard to believe that if one has had CCJ means he is not entitled to have citizenship.I did have some problems with my water utility company and eventually we agreed on paying in small instalments well i did not go to court but i replied my case through the internet and it was agreed while the second matter was i had problems with the house i was living and eventually it took a court order for the housing association to have their property...and this one i did not attend any court proceedings since i was already out of that house and i did not receive any court papers since they were sent to my temporary address so as fas as conviction is concerned i am not sure where that stands as i believe one is innocent until proved guilty by the court of law beyond reasonable doubt ..and thats the difference btn criminal and civil court judgment?

so do i have to reveal this information or what?

My friend i in some deep trouble as he has a Theft case and he did not state that he has an impedending court action..the dude has appealed but all i know he has some pretty bad records with them

Its County Court Judgement and has to do with payment defaults where the court has ordered you to pay up the amount. Read more about it in the link below

Ohh well..i think this website is really cool

I am also stuck in this limbo as no one knows what difference does it make

I have had two opinions on this

If you say YES then it might be a factor of being refused

If you say NO then if you are lucky you might as well get away with it as long as you dont have any CRIMINAL CONVICTIONS as i know someone who had more than a dozen CCJ and court orders of not paying rents and bills but still got his citizenship

A bit late to follow this up, but I have only just noticed that paragraph 4.6 of Guide AN(NEW) says:

"4.6 You must give details of all civil proceedings which have resulted in a court order being made against you...."

Which I think answers clearly the question as to whether you have to declare CCJs on your application form. It is also worth noting that they do not give a time limit for this - so all CCJs must be declared - no matter how old.

Hi All,

I have already submitted my application. I remember I had a court summon because of not paying my council tax on time. I did pay the tax and I didn't have to go to court.

I did not mentioned this in my application. Does this mean my application can get refused?

If there were no court proceedings, then I think you should be OK, as no county court judgement would have been made...

Hello guys..i am still here even though i did pass my LIUK test ages ago but i still havent applied for naturalisation from the Home office and i have been told its the biggest test yet

Anyways i know a friend who had a traffic offence and has received a refusal from the HO as he did not tell them he had an impending court date..or something like that.

So does anyone know what other common reasons that HO give refusals..apart from criminal record?

I do have CCJ as i did not pay my utility bill in time even though i agreed eith them that i will pay them in small instalments..u know u cant live in this country without debts

What about if one is unemlpoyed does that also affect their decision at HO?
