Dear Sir/Madam,

 

I was granted a Spouse visa in the Month of Feb’2012 in India.
My husband is a British Subject. He was born in Manchester. We meet in the USA in 1996, and got married in 1999.

 

We have been married for the past 12+ yrs. Before we decided to move to the uk for personal reason.

 

My hubby came here before me to take care of his mother who is in need of his help. I stayed back in the US to get things in order for the move to the UK. I applied for my visa from my native country India. Was granted a spouse visa in 40 working days, which was a joy to see. When I got to the UK we called the UK Home Office and asked how do I go about getting my ILR in the UK since we have been married for the past 12+yrs and living outside the UK. They told us that the Home Office In India had given me the wrong visa and that I needed to contact them. We have written to the British Consulate in India and is waiting for the reply

 

Please advise me as to what I should do next.

I think you are not to blame for the mistake of British Consulate in India. You can tell this to UKBA. If you are a spouse of a British Citizen, you worth getting a spouse visa from India. No mistake by them as well. If you stay together with your husband for 2 years with spouse/Leave to Remain visa in UK, you will be eligible to apply for ILR. No worries.
