Hi
i have been in the UK since september 2001 and i have been given limited leave to remain in 2008 and will expire in july 2011, do i have the right to apply for ILR and apply for naturalisation ?
help please

Hi,
In terms of the residence requirements for ILR/Settlement it is usually between two and five years, depending on your immigration category. For instance, the following are some of the main routes to ILR:


  • Legal residence - after five years (for example, spent on a Tier 2 visa)

  • Highly Skilled Migrant Programme (HSMP) or Work Permit - after five years (or four years if you received your HSMP before 3 April 2006)

  • Marriage or partner of a British citizen, or a person settled in the UK - after two years

  • Long residency - after ten years legal residency, or 14 years as a combination of illegal and legal residency

Whether or not you meet the residence requirement depends on several factors like: what visa you entered the UK under; whether or not you have had any absences from the UK since Sep 2001; or if you have broken any visas by late renewal or departure.

Can you give a bit more detail on how you have got to here?
