If an EEA citizen lives and works with their non-EEA spouse in another EEA state for 6 months or more, they have an absolute right to bring their spouse along when they return home. If a person meets the criteria under the 2004 EU Directive as the family member of an EEA national, then the time of residence is counted from the day you become a family member in the UK, not the dates on issued documents. You will probably also have to convince the UKBA that the relationship was a genuine one, before you came to the UK, and later when you came to the UK, and that your spouse was exercising Treaty Rights at the time of the divorce.

There is no provision for retention of the right to reside for an extended family member of an EEA national in regulations or directive(your friend cannot be regarded as a family member since the marriage is not recognised) however as the children are an EEA citizens she can have a derivative rights from them.

i need information my friend are non eea she came with visa she has family permit now she wants divorce her husband but they are not legally marriage by UK law but their marriage are religious marriage
they are marriage almost ten years and they live together three years in uk and her children are also eea citizen can some one help with this problem because she is really confused about it
