I suggest you look at the calender and work this all out. When my 8 year old nephew can work this out, I am sure you can too.
Just try to work out why and how we count an year every year so that every year the new year falls on 1st January :-/

It's not the problem of counting the years. Unfortunately in my case the 28 days falls exactly on the day of appointment, (If we take on 5th September 2010 I am completing my 5 years). I don't want to take a risk of spending 1500 pounds, and taking my kids with me. You may very well argue on changing my appointment date, if so thanks in advance, I have just requested for suggestions, not here to quarrel with any one

If you apply exactly 28 days before the date your visa expires, then that's  what it is: 28 days before.

No more, no less.

Option 2, thats is  28 days before you complete 2 years of saty in uk, since you got visa for 2 years and 3 months, I will advice you to complete the 2 years in full and apply for your ILR visa.

I have entered UK on 6th September 2005, and I got an appointment with the home office on 9th Aug 2010 for my ILR. In the guidance note its mentioned that “Please do not apply more than 28 days before completing the qualifying period”. I am complying with the requirement?
