You shouldn't have thought it twice about
the test and done it right away as the cost of the test and efforts are just a
fractional cost of applying for Citizenship.



Second point I want to make is that you are assuming that you have the right to
get a Citizenship, which is incorrect.  They have made so many changes and
on every step Home Office wants to tell you that Nationalisation is not a right
but kind of privilege. They have so many other reasons now to refuse Citizenship
then before. If you have a ray of light
and especially if it is not costing you arm and leg then by all means try that
option.

I want to tell you that you have done a
great job of re-opening the case but at the same time I suggest that you get
some professional help from a solicitor or an immigration professional on this
matter.  This is Christmas but see if
Paul can suggest you something as he is immigration expert and know things
better then anyone else.

Lastly, If Home Office have given you any
indication that you need to pass the test, I would run (Not walk) to do it right
away. This is a major requirement now and if you pass the test it supersedes
all previous requirements of ESOL Level 3 and so on.

thank you for your quick replay i really appriciated. since i think you know more about me on this metter, i've heard rumours that after aprill it would cost more then £2000 per application and to do some other tests? is that correct or just rumours, if it is correct can you provide me a link.

i have applied for british nationality on early Aprill, and i was refused due to breaking brange of 5 year period, seems that i have been living a year ilegell, which i did not, which they have told me i cant apply until 2009.i did complain to home office and had the cased reopened, but at that time i didnt pass my test, due to having letters from the doctor and i though i would be fine but i have recieved a letter now saying that i have to pass my test and send them the certificate? do you think that means that the are willing to give me british citizen if i do pass my test? the lady on the phone when i spoke to home office told me so, but i dont believe in it! they just want me and my family to spend money on tests, and refuese my application, please help me i am stuck on this metter and its costing me a great deal of stress and time

The requirements for naturalisation are fairly straightforward, I think, and one of the requirements is that the applicant must have been in the UK "legally" (ie with permission) throughout the five year residence period. Any gaps between visas can be taken into account, and if there is a gap, this can result in the clock starting again. I don't know nexhi salhu's circumstances, but it sounds to me as though the Home Office have identified such a gap, and that they are saying that his/her clock restarted as a result of it, some time in 2004.

It is impossible to tell whether their reconsideration of the application will result in its succeeding this time or not. But it seems to me that it is definitely worth taking the test, in order to give it a chance. Poor health can certainly be taken into account in excusing someone from taking the test, and it sounds as though they accepted that back in April but if it wasn't a permanent problem, I think they are justified in asking you to take the test now.

Bear in mind that a successful test result does not expire, so even if you take it and then they refuse your application anyway, you will still have the "pass" certificate to submit when you apply again in 2009. So I'd say, go for it.... Looking through the forums here, you can see plenty of posts from people who have passed it, so I don't think it is anything to be too nervous about.
