Hi Sumit,

According to my knowledge you have to mention about this when you submit your application because if you dont then you will be withholding very important information from the authurity which could get you into very big trouble in the future so there is no other option but to mention it and you can do so by using the last page of the form where they ask for any additional information but if you dont have this page then you can attach a separate sheet. i hope my answer will you and Good luck.

The solicitor who told you that bind over is not not a criminal conviction is a looney. Bindover is a criminal conviction, but not a serious one. It has a rehabilitation period of 12 months, or upto the date of order, whichever is longer. If you apply for naturalisation, before your sentence is "spent", then you will have to declare it and give relevant details. Caseworker may then exercise discretion, or may not.
My personal advice would be to wait until your bindover is spent, and then apply for naturalisation. This way you dont need to declare it, and a caseworker wont refuse you because you wont have any "unspent" convictions at the time of application.

Hi,


I am in a big trouble now.


I was arrested by police and was charged with breach of peace. I was told by the solicitor it is not criminal offence.


I was later given bindover for 12 months.


Now on the form they have asked for Do i have any criminal conviction or Civil judgement.


My bindover doesnt come in any of them. Do I still need to mention. If yes then whrere.


Can I tick no for criminal/Civil judgement question.



Please let me know, i would be highly oblidged
