Hi,


I would greatly appreciate comments from this forum.


I am a Canadian.  Initially, had a work permit that was valid until May 2011.  However, my limited leave to remain (spouse visa) that I applied "after" my work permit was only valid until 22nd of Nov 2010.  Without paying attention that the second one has nullified the first one, I always saw the May 2011 expiry and felt I was OK... until now (30 March 2011).


I am told that I am still able to apply for ILR under out-of-time scheme. 


My wife and I have lived in the same home for the last 2.5 years, have joint accounts and have the documents to support that.  I also have 3-points on my driving licence.  We have savings and no mortgage. We have never used public funds.


1) Given I pass the Life in the UK Test, what are my chances of success in obtaining my ILR through out-of-time scheme some four months after the expiry?


2) I have been told that there is always a risk of refusal with no ability for appeal.  This means I have to go back to Canada and re-apply.  How long this process takes? What would be my chances then?
