How long did she lived in U.K in total?
that is what is important.
She shall have lived close to 5 years for her ILR. I think she will get some leave away because you apply as a married couple but not years. more over the duration of your marriage is not very long.

Thanks for the reply.


She came to UK in October 2006. We were living together from that time but got married in February 2008.


We have lived together for the past 2 and half years and it will be almost 3 years when I apply for ILR in August.


Will this be ok ?

Hi,


I just got called the Home office and got answer for my query.


My wife will not be able to get an ILR along with me as she is not a dependent on me.


The only way she could get the ILR is by converting her status to dependent on my HSMP visa.


For converting the status to dependent she had to travel back to country of her origin.


If she is not converted to dependent she could only get the ILR in her own visa capacity after completing 5 years.


Thats what they said.

Hi ,


I got a situation here and hope somebody would guide me.


I am on HSMP and will be completing 5 years in August 2009.


My wife came to UK on HSMP and we are married in February 2008. She is still on her HSMP and is not dependent on me.


Is she eligilible to get an ILR along with me If I apply for ILR in August


or


Do I need to change her visa status as dependent before applying for ILR ?
