Hi


My husband entered UK with a spouse visa, I am a british citizen.


His visa valid from 24 Apr 2009 expire on 24 Jul 2011, he arrived UK on 5 Aug 2009 . According to the HKBA website he needs to complete 2 full year before he can apply the ILR but base on the 28 days before visa expire would be 22 Jun 2011,  but at that time he still need 12 more days to  complete the 2 years period.


Is that mean he still needs to extend his visa first?


I have also check the website it says:

If you were given permission to enter the UK as a husband, wife, civil partner or unmarried/same-sex partner but you then delayed your travel to the UK by up to three months, you can apply to live here permanently using application form SET(M) shortly before your permission to enter ends. As long as you meet the other requirements of the rules, we will put your application on hold until you have completed your two-year qualifying period in the UK.


would he under this area if so what day i should hand in the application? 


 I am really confused and actually called the home office but they just told me to refer their website... it should have everything there...
