I hope your solicitor is acting for nothing, because that is the precise value of the advice you have received!
You need to have been in UK for three years and,
on the day of application, you need to have no time limit on your stay, and you need to be married to a British citizen.
You do
not need to have ILR for a year if you are married to a BC.
If you arrived in UK in February 2004, you can apply for naturalisation in Feb 2007.
