On what basis did your son acquire his ILTR status?


Normally one is eligible to apply for naturalisation after one year has elapsed since acquiring ILTR (subject to meeting the required conditions).

He was eligible to acquire ILTR under being a dependant under 18, under her mother's sponshorship who at that time acquired her ILTR (after 4 yrs residence). Same goes with my daughter (under 18).

My son arrived here on May 2003 on a "dependant" visa (under his mother's sponsorship who was at that time a Work Permit Holder). My son was 15 years old that time. Eventually he acquired his ILTR status on May 2005 (before turning 18). He turned 18 on Dec 2005, and has been a resident in the UK for 3 yrs and 10 months from first arrival. Can he be eligible for citizenship (as for a spouse which only requires 3 yrs residence if married to a citizen) or does he have to wait for the 5-year residence requirement to qualify. Can he not have same privileges of a citizen's spouse, which only requires 3 yrs residence considering his "dependent" visa when he first entered the UK? I've had different views on this. Most advice say he must complete the 5 yr residence requirement, being an adult (18+). Would appreciate any advice. Best regards. // Levy
