Hi Kashif

You said you came in the UK in 2004, did you have a student visa? If so, when did your student visaa expire? Was it before you get married or after?  If it is after you got married, it means that from 2004 to 2009, you had 5 years continuous legal stay in the UK, therefore you can apply for your permanent residence known as ILR (ILR:indefinite leave to remain). Before you do so, make sure you pass the life in the UK test.

It is only after you have spent one year on your ILR document that you can naturalize as a British citizen. If you need further information, contact your nearest Citizen Advice Bureau, the following link will help you locate one.

hi mate

thanks very much for your reply

well i had student visa till october 2006 but i got married in april 2006 . so i was legally residing in uk when i got married.. and 2nd thing i have checked home office web site.. they mentioned there.. if you are Eu family member you all have automatically permanent residence after five years.. and other thing being a EU family member i dont need to appy for ILR . to be naturlise as british citizen.. it is all on home office website. under eu section naturalisation .

well question is  can i apply for citizenship now or when i spend five years being a eu family member?

i have called 3 times to home office. trust me . every time they give different information .. i dont know wht to do ..

if you click on this link

http://www.ukba.homeoffice.gov.uk/britishcitizenship/eligibility/naturalisation/spouseorcivilpartnerofcitizen/

and go to European Economic Area nationals and Swiss nationals section by scrolling down the page. you ll see all the information .. but probably i cant get.. if i apply now .and they refuse.. then i ll loose about 930 pounds.. for joint application ../

would you just look up the above link and tell me what actually it is meaning

thanks a lot

lot of wishes

If your spouse is British you are not regarded as an EU family member under the terms of the law. I have no automatic residence rights despite being married to a Brit for twenty-one years. But I can acquire it after working or being otherwise 'qualified', i'e. self-sufficient (which is almost impossible due to the 'comprehensive sickness cover' clause) after three years have passaed, rather than the usual five years.

well here is some thing . .about me struggling being a EU family member lol

i came to uk as a student , in 2004 july . and then got married with eu national in 2006 . after that i was issued resident card till 2012.  and in 2008 my passport expired . and i send my application to home office to transfer the residence card stamp on new passport. but they issued me a new resident card. which is valid .till 2014..

my wife has been here from december 2004 and she recently got her PR .. to get british passport.. as she is EU national . so there wasnt any problem..

question is when actually i can apply for pr. or naturalization.as a british national. being a eu family member in 2011 it will be total of 5 years.. .but in the country i have been more than 6 and half years.

should we send our joint applicatio for citizenship. . or she should apply 1st.

guys . any idea.. . plz help me out .. i am so confused..

thanks

regards
